This version applies to THETA Render obtained from the Microsoft Store.
Your projects and renders never leave your computer. All processing runs locally on your GPU. We do not run a licence server and THETA Render sends us no data. When it starts, THETA Render asks Windows whether your Microsoft account has bought the app or is in the free trial; Windows and the Microsoft Store answer under Microsoft's own privacy statement. No images, projects or information about your computer are sent to us.
THETA Render has no analytics, no telemetry, no advertising and no automatic update check of its own. Updates are delivered by the Microsoft Store.
2.1 Athanasios A. Bampanelos ("we"), established in Greece (postal address on the Microsoft Store page and at thetarender.com), is the controller of the personal data described in sections 3(b) and 3(c).
2.2 Microsoft (Microsoft Corporation and its affiliates, which operate Windows and the Microsoft Store) handles your purchase, payment, tax, invoicing, refunds and the licence and trial status of the app. For these purposes Microsoft is an independent controller under its own privacy statement (available at https://privacy.microsoft.com). We do not control and are not responsible for what Microsoft does with its data.
(a) Data we never receive. We do not receive your images, projects, renders, prompts, file names, screenshots, hardware identifiers, computer name, user name, operating-system details, usage statistics, your payment details, or the date on which you started the free trial. The application does not send them. The rendering engine runs only on your computer and listens only on the local address 127.0.0.1.
(b) Purchase data. Microsoft handles your purchase and payment and does not give us your payment details. Microsoft provides us with reports about sales and downloads in Partner Center, such as the number of acquisitions per country, and the amounts it pays us. If a report contains information that identifies a customer, we use it only to keep our accounts, meet accounting and tax duties, answer your requests and understand how the app is distributed, and we keep it as described in section 7. Legal bases: performance of the contract with Microsoft, legal obligation (GDPR Art. 6(1)(c)) and our legitimate interest in running the business (Art. 6(1)(f)).
(c) Licence check. THETA Render asks Windows for the licence and trial status of your Microsoft account for this app. The question and the answer stay between THETA Render, Windows and Microsoft; nothing is sent to us. Windows needs an internet connection to refresh the status from time to time. If Windows cannot answer, THETA Render works for up to 7 days after the last confirmed licence (see the EULA, clause 8.3). The result is never treated as a disabled licence because of a failed or unclear check.
(d) Diagnostic data. Depending on your Windows privacy settings, Windows may send diagnostic and crash data about apps to Microsoft, and Microsoft may make aggregated health reports (for example crash counts) available to us in Partner Center. We do not receive reports that identify you. Legal basis: our legitimate interest in keeping the app working (Art. 6(1)(f)).
(e) Support. If you write to us, we process your email address, your message and any file you choose to attach (for example the log file comfy.log). Send only what you are happy to share. Legal basis: performance of the contract and our legitimate interest in answering you (Art. 6(1)(b) and (f)).
(f) No marketing. We do not use this data for marketing. We will only send you product announcements if you ask for them. Providing the data in (b) to (d) is not required from you by us; any data you give Microsoft is covered by Microsoft's privacy statement.
THETA Render stores settings, a log file (comfy.log), a small file that lets the plug-in find the running application, a short record of the licence checks (store_status.log) and the date of the last confirmed licence (used only for the 7-day offline period), in the folder %APPDATA%\THETA Render. The log files described in this section remain on your own computer and are not transmitted to the Licensor. You can delete the folder at any time. The free trial and licence are kept by Microsoft and Windows, not by this folder. Uninstalling THETA Render through Windows removes the app; its data folder may remain, and you may delete it yourself.
5.1 Microsoft, as described in section 2.2.
5.2 Our email and web-hosting providers, which process support emails and website requests on our behalf.
5.3 Our accountant and the Greek tax authorities, for the records we must keep by law.
We do not sell your data.
Microsoft may transfer data outside the European Economic Area under the safeguards in its own privacy statement. We do not ourselves transfer your data from the app. Our own providers are listed on request.
7.1 Sales and payout records from Microsoft: for the period required by Greek tax and accounting law.
7.2 Support emails: 24 months after the last message about the matter.
7.3 Microsoft keeps its own records according to its privacy statement.
7.4 Records of a dispute or legal claim: up to six years after closure of the matter, unless a longer period is required for legal proceedings or legal obligations.
7.5 We keep as little as possible. We take nothing from your computer. We do not build our own customer database or mailing list.
8.1 You may ask us for access to your data, correction, erasure, restriction, portability, and you may object to processing based on legitimate interests (GDPR Articles 15 to 21). Write to contact@thetarender.com. We answer within one month. For data held by Microsoft as its own controller, contact Microsoft.
8.2 You may complain to the Hellenic Data Protection Authority (www.dpa.gr) or to the authority of the country where you live.
We do not use profiling. The licence check only reads whether Windows reports the app as licensed or in the trial. If Microsoft refunds or reverses a purchase, Windows withdraws the licence and THETA Render treats the copy as not licensed. We do not decide this. If the check cannot be completed or the answer is unclear, the licence is never treated as withdrawn. The end of the free trial is decided by Microsoft's trial rules; no data about you is used by us.
THETA Render makes no connection of its own to us. We apply appropriate technical and organisational measures to protect the data we hold. No system is completely secure.
The current version is available at thetarender.com/privacy, on the Microsoft Store page and under About in THETA Render. If a change affects what data is collected, we will say so in the release notes of the version concerned.
